1. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your country) to use AI Sports Creator. If you are under 18, you may use the Service only with parental or guardian consent.

2. Use of the Service

AI Sports Creator allows users to upload photos and generate AI-created sports portraits and other digital artwork.

You agree to:

• Use the Service only for lawful purposes.
• Not upload images that are illegal, harmful, infringing, or violate third-party rights (including copyrights, trademarks, or likeness rights).
• Not use the Service to create defamatory, obscene, hateful, or otherwise offensive content.

3. Image Quality & AI Results

The outcome of the generated images depends largely on:

• The quality of the photos you upload (clear, well-lit, and suitable images).
• Your compliance with the rules outlined in these Terms (e.g., no multiple persons, obstructions, or unauthorized content).

While we use advanced AI technologies, the results may sometimes differ from your expectations. We do not guarantee that every generated image will meet your intended style, likeness, or quality. By using the Service, you acknowledge and accept that AI outcomes are variable and may not always be perfect.

4. User Content

• Ownership: You retain ownership of the images and content you upload ("User Content").
• License to Us: By uploading User Content, you grant us a worldwide, non-exclusive, royalty-free, sublicensable license to store, process, modify, and use your content solely to provide and improve the Service.
• Storage & Processing: Your images are stored on Amazon Web Services (AWS S3) and processed through third-party AI services such as FAL and Replicate. By using the Service, you consent to this storage and processing.
• Deletion: You may request deletion of your User Content at any time. We will take reasonable steps to remove it from our systems and third-party services where technically feasible.

5. Intellectual Property

All rights in the Service, including the app, designs, software, logos, and generated outputs (except for your User Content), are owned by AI Sports Creator or its licensors.

Generated images may be used by you for personal, non-commercial purposes. For commercial use, you are responsible for ensuring you have the necessary rights and permissions.

6. Third-Party Services

Our Service integrates third-party providers (including AWS, FAL, and Replicate). We are not responsible for their services, availability, or security practices. Your use of their services may also be subject to their terms and privacy policies.

7. Subscriptions & Payments

Access to certain features may require a paid subscription. Fees, billing cycles, and refund policies are disclosed in the App Store or Google Play at the time of purchase. All payments are handled by the respective platform and are subject to their terms.

8. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis. We make no warranties or representations about the accuracy, reliability, or availability of the Service or any generated content. Use of the Service is at your own risk.

9. Limitation of Liability

To the fullest extent permitted by law, AI Sports Creator and its affiliates are not liable for any indirect, incidental, or consequential damages, including loss of profits, data, or goodwill, arising from your use of the Service. Our total liability to you shall not exceed the amount you paid us in the last 12 months.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Switzerland. Any dispute, controversy, or claim arising out of or in connection with these Terms, or the use of the Service, shall be subject to the exclusive jurisdiction of the competent courts of Switzerland.

11. Termination

We may suspend or terminate your access to the Service if you violate these Terms. Upon termination, the license you granted us to process your User Content will end, but we may retain copies as required for legal, regulatory, or legitimate business purposes.

12. Changes to These Terms

We may update these Terms from time to time. When we do, we will post the revised version in the app and update the "Effective Date." Continued use of the Service means you accept the updated Terms.
