Terms of Use

Welcome to AI Sports Creator ("App", "Service", "we", "our", or "us"). By downloading, accessing, or using our mobile application, you ("you", "user") agree to these Terms of Use. Please read them carefully. If you do not agree, you must not use our Service.

1. Eligibility

You must be at least 16 years old (or the age of digital consent in your country, if higher) to use AI Sports Creator. The Service is not intended for, and is not directed to, children. By using the Service, you confirm that you meet this age requirement.

2. Use of the Service

AI Sports Creator allows users to upload photos and generate AI-created sports portraits and other digital artwork.

You agree to:

• Use the Service only for lawful purposes.
• Not upload images that are illegal, harmful, infringing, or violate third-party rights (including copyrights, trademarks, or likeness rights).
• Not use the Service to create defamatory, obscene, hateful, or otherwise offensive content.

3. Image Quality & AI Results

The outcome of the generated images depends largely on:

• The quality of the photos you upload (clear, well-lit, and suitable images).
• Your compliance with the rules outlined in these Terms (e.g., no multiple persons, obstructions, or unauthorized content).

While we use advanced AI technologies, the results may sometimes differ from your expectations. We do not guarantee that every generated image will meet your intended style, likeness, or quality. By using the Service, you acknowledge and accept that AI outcomes are variable and may not always be perfect.

4. User Content

• Ownership: You retain ownership of the images and content you upload ("User Content").
• License to Us: By uploading User Content, you grant us a limited, worldwide, non-exclusive, royalty-free license to store and process your content solely to generate the images you request and to provide the Service to you. We do not use your photos to train AI models or for any purpose other than delivering the Service.
• Storage & Processing: Your images are stored on Amazon Web Services (AWS S3) and processed through the third-party AI provider FAL.ai to generate your results. By using the Service, you consent to this storage and processing.
• Deletion: You can delete your account and all associated data (including your generation history and your stored images, both originals and generated results) directly in the app at any time. Deletion removes this data from our systems. See our Privacy Policy for details on retention and your rights.

5. Intellectual Property

All rights in the Service, including the app, designs, software, logos, and generated outputs (except for your User Content), are owned by AI Sports Creator or its licensors.

Generated images may be used by you for personal, non-commercial purposes. For commercial use, you are responsible for ensuring you have the necessary rights and permissions.

6. Third-Party Services

Our Service relies on third-party providers, including Amazon Web Services (image storage), FAL.ai (AI image generation), and RevenueCat together with the Apple App Store and Google Play (subscriptions and payments). We are not responsible for their services, availability, or security practices. Your use of the Service may also be subject to their terms and privacy policies.

7. Credits & Payments

Image generation uses credits. You purchase credits through in-app purchases, and each successful generation consumes the number of credits shown on that style before you start it. Styles may cost different amounts, and the price of a style can change over time; the cost is always displayed before you spend anything. If a generation fails, the credits it used are automatically refunded to your balance.

Your credit balance and purchases are managed by RevenueCat. All payments are processed by the Apple App Store or Google Play; we never receive or store your payment card details. Prices, applicable taxes, and any refund policies are disclosed at the time of purchase and are subject to the platform's terms.

If you reinstall the app or switch to a new device, you can use Restore purchases in Settings to re-link purchases made with the same store account. Credits are tied to your account, not to a single installation. Deleting your account permanently forfeits any remaining credit balance.

8. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis. We make no warranties or representations about the accuracy, reliability, or availability of the Service or any generated content. Use of the Service is at your own risk.

9. Limitation of Liability

To the fullest extent permitted by law, AI Sports Creator and its affiliates are not liable for any indirect, incidental, or consequential damages, including loss of profits, data, or goodwill, arising from your use of the Service. Our total liability to you shall not exceed the amount you paid us in the last 12 months.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Switzerland, and the competent courts of Switzerland shall have jurisdiction over any dispute arising out of or in connection with these Terms or the Service.

If you are a consumer resident in the European Union, the United Kingdom, or another jurisdiction with mandatory consumer-protection laws, nothing in these Terms deprives you of the protections and rights granted to you by the mandatory laws of your country of residence, including your right to bring proceedings in your local courts.

11. Termination

We may suspend or terminate your access to the Service if you violate these Terms. Upon termination, the license you granted us to process your User Content will end, but we may retain copies as required for legal, regulatory, or legitimate business purposes.

12. Changes to These Terms

We may update these Terms from time to time. When we do, we will post the revised version in the app and update the "Effective Date." Continued use of the Service means you accept the updated Terms.
