Privacy Policy

This Privacy Policy explains how AI Sports Creator ("App", "Service", "we", "our", or "us") collects, uses, and protects your personal information when you use our mobile application. We are committed to processing your data in accordance with the EU General Data Protection Regulation (GDPR) and the Swiss Federal Act on Data Protection (nFADP).

1. Data Controller

The controller responsible for your personal data is AI Sports Creator, Switzerland. For any privacy-related request, you can reach us at contact[at]aisportscreator.com.

2. Information We Collect

We keep data collection to the minimum needed to run the Service. We hold:

• Photos you upload: The images you provide so we can generate your AI results, and the generated result images. You choose each photo either from your photo library or by taking a new one with your camera. Some styles ask for more than one photo, and some let you add an extra photo (such as a t-shirt) that is entirely optional. We only receive the photos you actually choose: if you skip an optional one, it is never uploaded.
• An anonymous account identifier: A pseudonymous identifier assigned by RevenueCat to your installation. It is not your name, email, or phone number; it simply lets us keep track of your credits and generation history. We do not ask for or collect your name, email address, or phone number.
• Generation metadata: Records of your generations (the style you chose, status, timestamps, and references to your stored images), used to show your history and operate the Service.
• Subscription status: Your credit balance and purchase status, managed by RevenueCat. Payments are handled by the Apple App Store or Google Play; we never receive or store your payment card details.

We do not use analytics or tracking SDKs, advertising identifiers, or cookies, and we do not build behavioral profiles of you.

3. How We Use Your Data & Legal Bases

We process your data only for the following purposes:

• To provide the Service: storing your photos, generating your requested images, and showing your history. Legal basis: performance of a contract (GDPR Art. 6(1)(b)).
• To access your photo library: to let you pick the photo or photos a style needs (some styles ask for more than one, and some offer an optional extra you may skip) and to save your generated results back to your device, only after you grant the system photo permission. Saving a result writes a copy to your own device; it is not shared with us. Legal basis: your consent (GDPR Art. 6(1)(a)), which you can withdraw at any time in your device settings.
• To use your camera: to let you take a new photo for a style instead of picking an existing one, only after you grant the system camera permission. The camera opens solely when you choose "Take a photo", and only the shot you keep is uploaded. We do not record video or use the camera in the background. Legal basis: your consent (GDPR Art. 6(1)(a)), which you can withdraw at any time in your device settings.
• To share a result you choose to share: when you tap Share, your device's own share sheet opens and you pick where the image goes (for example a messaging app). The image is then handled by that app under its own privacy policy, not ours. Nothing is shared until you choose a destination. Legal basis: your consent (GDPR Art. 6(1)(a)).
• To manage credits and purchases: via RevenueCat and the app stores, including restoring purchases you have already made when you reinstall the app or switch device. Legal basis: performance of a contract.
• To keep the Service secure and comply with the law. Legal basis: our legitimate interests and legal obligations (GDPR Art. 6(1)(f) and (c)).

We do not use your photos to train AI models, and we do not sell, rent, or share your personal data for advertising.

4. Where Your Data Is Stored & International Transfers

• Images are stored on Amazon Web Services (AWS S3) in the EU (Stockholm region).
• Generation metadata and your anonymous identifier are stored in a PostgreSQL database hosted in the EU.
• AI generation is performed by FAL.ai, and subscription management by RevenueCat. These providers may process data in the United States.

Where data is transferred outside Switzerland or the European Economic Area, we rely on appropriate safeguards such as the European Commission's Standard Contractual Clauses (and their Swiss equivalent) to protect your data.

5. Data Retention

We keep your uploaded photos, generated results, and generation history for as long as your account remains active, so you can view and re-download your creations. You can delete an individual creation at any time from your history, which removes that generation and its stored images (the original and the result) from our systems. You can also delete all of this at once from within the app (see "Your Rights" below); when you do, we remove your account record, your generation history, and your stored images (originals and results) from our systems. Note that purchase records held by RevenueCat, Apple, or Google are retained by those providers under their own policies and are outside our control.

6. Data Security

We implement reasonable technical and organizational measures to protect your information from unauthorized access, loss, or misuse. Images are accessed only through short-lived, signed links, and our AI provider receives only temporary access to the image needed for your generation. However, no system can be completely secure, and we cannot guarantee absolute security.

7. Sub-processors

We rely on the following providers to operate the Service, each acting under its own privacy policy:

• Amazon Web Services (AWS): image storage (EU).
• FAL.ai: AI image generation.
• RevenueCat: subscription and credit management.
• Heroku (Salesforce): application and database hosting (EU).
• Apple App Store / Google Play: payment processing.

8. Children's Privacy

AI Sports Creator is intended for users aged 16 and over (or the age of digital consent in your country, if higher) and is not directed to children. We do not knowingly collect personal data from children. If you believe we may have collected such data, please contact us and we will delete it promptly.

9. Your Rights

Under the GDPR and Swiss nFADP, you have the right to access, rectify, erase, restrict, and port your personal data, and to object to certain processing. Because we operate on anonymous identifiers, the most direct way to exercise your erasure right is to use "Delete my account & data" inside the app, which removes your data as described above. For any other request, contact us at the email below.

You also have the right to lodge a complaint with a supervisory authority. In Switzerland this is the Federal Data Protection and Information Commissioner (FDPIC); in the EU it is the data protection authority of your country of residence.

10. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. When we do, we will update the "Effective Date" and publish the new version in the app. Continued use of the Service means you accept the updated Privacy Policy.
